

| Customer Location Procedure Policy:
The Welder will perform his duty in good faith, but due to the high risk of visitation with at job sites, public areas or simply stranded, we require that the caller use a credit card to pay a non-refundable Service Call Fee in advance. It is a mutual benefit to explain over the telephone of the intended service that the caller requires, in order that the welder can confront the situation efficiently. If the material is other than carbon steel or cast iron, which are the most common, it will be ideal to communicate to the welder the base material composition. Let the Welder know if extra material is needed to complete the task or if transportation of heavy parts might be needed, so the welder can take a trailer in case such need arise. The Welder will not depart for the customer's job site until a proper location is disclosed and an address is identified in relation with the credit card holder. Upon arrival, the caller or person in charge has to provide proof of financial responsibility, including proper identification and ownership or authorization from the owner to work on the equipment or site. It is imperative that the owner or person in charge inform the welder of any presence or suspicion of combustible, accelerant, electricity, gases, chemicals or any circumstance that imperil the safety of human life upon striking an arc. The owner or person in charge has to sign documentation authorizing the work, payment commitment, release of liability and related terms. Upon completion of the work to the satisfaction of the owner or person in charge, the client will liquidate the incurred monetary charge without demur.
Jobs at the shop are taken on a good faith basis. Invoices for materials and consumables are required to be paid at the time of order agreement. No payment is required in advance for labor, but the owner or person in charge has to demonstrate financial responsibility and sign a written authorization, payment commitment, release of liability and applicable terms. Upon completion of the job to the customer satisfaction the welder requires liquidation of the agreed balance. No personal property of the client is allowed to leave the shop premises until complete payment is rendered. If the final product is not done to the customer's satisfaction, either because the customer did not communicate his project clearly to the welder, or due to the inability of the welder to produce the job to the customer's satisfaction, the object(s) will remain property of the welder and the customer is responsible for the wasted material along with a fair surcharge to compensate for electricity, expended consumables and the use of the equipment and facilities. This applies to situations where the customer provides the material and the only charge expected is labor and the surcharge for equipment usage, consumables and generating fuel, on an hourly basis. This charge has to be paid with a credit card and is non-refundable. The Welder will depart for an on-site project until a proper location is disclosed and an address is identified in relation with the credit card holder. The owner or person in charge has to sign documentation authorizing the work, payment commitment, release of liability and related terms. Upon completion of the work to the owner satisfaction, the owner will liquidate the incurred monetary charge without demur. Upon arrival, the owner must have proof of financial responsibility including proper identification and ownership of the property to be able to attain a quote. It is imperative that the owner inform the welder of any presence or suspicion of combustible, accelerant, electricity, gases, chemicals or any circumstance that imperil the safety of human life upon striking an arc. In regard to contracted jobs where the Welder has to purchase materials and fabricate components before the installation, Fifty Percent (50%) of the contracted amount is required prior to commencement of work. Since metal is very heavy, handling the material constitutes a great deal of the cost, and therefore the upfront payment is non-refundable after material is purchased and delivered to the shop. Under normal circumstances material is delivered within 2 to 3 days after the agreement is signed. Cancellations of agreements for contract welding before receiving material will result in a Service Call Fee to cover the cost of estimating, ordering material and related errands. Cancellations of agreements for contract welding after the material has been received, but prior to work being commenced, will result in forfeiture of materials cost, but the customer may come to take possession of said materials. Cancellations of agreements for contract welding after commencement of work on the project will result in forfeiture of the money and materials. On internal installations, the remaining balance of Fifty Percent (50%) of the contracted agreement has to be liquidated after a quality approval by the owner, but before internal installation commences. Failure to settle the remaining balance immediately after acceptable external installation or proper delivery implies a concession of the real estate owner to the Welder for the Welder to enter the premises and remove the subject part anytime thereafter, which in such situation also exonerates the Welder from removal damages to the real property in the repossession. To minimize potential disagreements and capital loss, on both parts, it is strongly suggested to use a series of escalation steps as the metal work progress. The first step should be a CAD drawing. By abiding to a drawing, the Welder is subject to a higher degree of standards and the owner can achieve a clear vision of the project before hand. Such drawing could be supplied by the owner or by a third party to the Welder. If the Welder has to do the drawing, there will be a fee in accordance with the job, payable up front to cover the utilization of resources such as software, equipment utilization and time invested in the project. The owner will own the drawing composition thereafter. This drawing is usually transferred via e-mail in a pictorial PFD or conventional CAD format. The Welder is willing to modify the drawing once at no charge to accommodate the customer needs. The Welder will allow an order cancellation, before purchasing material, in exchange for a Service Call Fee. The Welder will allow the customer to pick up pre-paid material purchased with his money before it is cut, in addition to a handling fee not to exceed 50% of the cost of the material. Material that has been cut or partially assembled is not returnable and considered property of the Welder until finial payment is received. No money or material can be returned at this advanced stage. To facilitate this process the Welder will forward at least two (2) pictures per week of the work in process via e-mail to the principal party for quality assurance and style awareness. Hearing no objections from the contracting party constitutes an implicit acceptance of the progress of the project up to such stage. Repetitive or pre-arranged customers with outstanding payment record or good working conditions could benefit with priority service and minimum payment requirements. Cooperation with the Welder with non-welder tasks at the job site, such as mechanical disassembly, cleaning or simple organization to expedite the weld job, is always welcome, as long as such assistance is not negligent, and does not create an unnecessary risk of injury or death. The customer authorizes the Welder to enter the premises where the service is to be performed to install, modify or retrieve the metal pieces in question. The customer will allow the time necessary to complete the job or correct any inaccuracy. The metalwork is to be performed within business hours and preferable during daylight hours. Contracting the services of the Welder or providing materials upon which work is to be done constitutes an engagement for monetary compensation. Repairs or small projects that are verbally agreed upon shall be honored, and payment is expected upon completion of the project by the Welder. The owner or person in charge should identify hidden materials, pipes or wires that could affect the welding process or part installation. The owner or person in charge will make sure that there are no flammables, combustable gases or accelerants near the selected welding area or proximity. The owner or person in charge will make sure there is no electrical, chemical or radioactive peril present at the job site. The owner or person in charge will make sure that any scaffold, platform, ladder or sub-floor structure is secure and suitable to the weight of the job. Under any circumstance the Welder is liable for any fire, explosion, physical injuries or material damages that may occur after a fair and proper disclosure of potentially hazardous circumstances by the property owner or person in charge has been made. Failure of the customer or his representative to disclose hazards that may result in fire damage shall absolve the welder of any responsibility, financial or otherwise, resulting from damage to or destruction of the customer's property, facilities or furnishings, as well as injury to or death of occupants of the building. In the event of disputes regarding the quality of workmanship the services of an independent arbitrator shall be employed. The final disposition of arbitration shall be binding upon all parties. The resulting fee will be divided equally among the parties to the arbitration action. |
